County seal violates Constitution?

Caldwell, Idaho -- The official seal of Canyon County may be under attack due to a lack of religious diversity.

The seal features aspects you might see in any small Idaho community, but it's the object in the middle that has upset at least one county resident.

The object is a small church, with an even smaller cross on top the steeple.

The complaint has reached lawyers at the American Civil Liberties Union of Idaho, who say they are not likely to pursue the issue.

"We don't think that it's likely to be recognized by the courts as violating the establishment clause of the First Amendment.  We don't think the courts would recognize this as a constitutional violation, but we haven't decided yet," said Jack Van Valkenburg, ACLU of Idaho.

The person who is upset by the design is a man named Randy Hooban of Caldwell. Hooban believes the seal does violate the First Amendment.

ACLU officials say they'll make up their minds on the issue by the end of June.
